Use of data accessed via this service
Access to this dataset is governed by the following Terms of Use:
- ECMWF retains all Intellectual Property Rights and copyright over its data.
- ECMWF must be acknowledged (attributed) as the source. Attribution must be displayed prominently and include ‘this document/data/output/Results is/are based on data and products of the European Centre for Medium-Range Weather Forecasts (ECMWF)’. Users must remove attribution if requested by ECMWF.
- ECMWF does not accept any liability whatsoever for any error or omission in the data, their availability, or for any loss or damage arising from their use.
- ECMWF makes no warranty as to the accuracy or completeness of its data products or the uninterrupted provision of such data products. All data products are provided on an "as is" basis. Any warranty implied by statute or otherwise is hereby excluded to the fullest extent permissible by law.
- ECMWF shall not be liable should ECMWF discontinue the provision of its data products at any time.
- Access to the data products and services may be unavailable, delayed or interrupted. ECMWF will make reasonable efforts to restore the access following the report of a problem, but ECMWF will not be liable for any unavailability, delay or interruption in access. The Licensee is granted Access to the Archive Products via the ECMWF Web API for the period indicated in the Sales Order.
- Access to the data products and services is limited to three (3) accounts per organisation/corporate group, including all subsidiaries, affiliated entities, and parent companies with direct or indirect control relationships. Attempts to circumvent this limitation may result in immediate termination of any or all accounts without refund.
- The Licensee undertakes to follow the ECMWF Information Security Policy and other relevant information security regulations, including password management policies. Identifiers, passwords, and any other security information or devices received from ECMWF must not be made available to third parties under any circumstances.
- If applicable, all ECMWF's fees and charges are exclusive of and net of any Taxes which may be levied. The Licensee is liable for all Taxes and shall pay ECMWF's fees and charges in full without deduction or set-off. If compelled by local law to deduct Taxes, the Licensee will pay ECMWF such additional amounts as are necessary to ensure receipt of the full invoiced amount.
- ECMWF is an international organisation established by Convention with a Protocol on Privileges and Immunities, exempt from UK taxes and not required to be registered for UK VAT. ECMWF does not have a VAT number so VAT will not be applied to its invoices.
- These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales.
- The parties shall attempt to settle any dispute in an amicable manner. If the dispute cannot be so settled, it shall be finally resolved under the Rules of Arbitration of the International Chamber of Commerce by one or three arbitrators sitting in London, England. The proceedings shall be in English. In accordance with Sections 45 and 69 of the Arbitration Act 1996, the right of appeal to the English courts on a question of law is excluded.
- Nothing in these Terms of Use shall be construed as a waiver of any of the privileges and immunities conferred upon ECMWF by its Member States through its Convention and Protocol on Privileges and Immunities.
- If the licensee is defined as a Research Project User, the Licensee is subject to the ECMWF definition of Research and Results:
- Research Project: A time-bound project for non-commercial research purposes only. Continuous services based on ECMWF Products are not permitted without written consent. Results must be openly available at delivery costs only, without delay linked to commercial objectives, and submitted for open publication.
- Research licences cannot exceed the duration of the project or 3 years, whichever is shorter. Renewal is possible for projects exceeding 3 years.
- Results: may include written reports, publications, presentations, and other forms of research output that do not involve the distribution of or real-time services based on ECMWF Products, unless permission is granted.
- Research Project Users are prohibited from providing services for both commercial and non-commercial purposes. Breach will result in termination of accounts.
- If a Sales Order including Service Charges is signed:
- The Licensee shall pay Service Charges within 30 days of invoice.
- Invoices are issued in the currency specified in the Sales Order. Payments in other convertible currencies may be subject to a 5% surcharge to cover exchange rate risk.
